Orders must be submitted electronically through the BearTartan.com web site and are in all cases subject to acceptance by BearTartan.
Availability and pricing might change before we have an opportunity to update our Web site. Rarely, prices may be inaccurately displayed on our site due to system errors. While we make every attempt to avoid these errors, they may occur. We reserve the right to correct any errors when they do occur. Prices are determined on the date that the goods are charged. We reserve the right to alter the prices quoted on the on-line store in light of fluctuating supply prices, exchange rate movements or for any other reason beyond our reasonable control.
The prices for kilts shown in the BearTartan web site may vary from time to time. Sales to addresses within the European Union are shown inclusive of VAT. All Non EU (USA, Canada & Rest of the World) prices are shown exclusive of VAT, but include a small currency conversion charge of 2.5%.
Once payment has been accepted and transferred, your order will be processed.
Kilt Prices do not include the following for which you are additionally liable:
Shipping and packaging costs and currency conversion (where applicable).
You will see this charge calculated and displayed on-screen before you are asked finally to confirm your order.
Value Added Tax (VAT) is charged automatically on the kilts for delivery within the European Union; Deliveries to other areas of the world (including North America & Canada) are exempt and are charged at ex-VAT prices.
Where VAT is deducted for non-EU countries, duty may be imposed by the country of the destination. If so, these duties/taxes may have to be paid by you on receipt of the kilt. Like many international retailers, we can accept no responsibility for duties and other import taxes which certain countries (or states) may apply to your order. By placing your order with us you are assuming all responsibility for the legality of personally importing the kilt.
Important: Remember that these duties/taxes are offset by Bear Tartan selling you the kilt at tax free prices.
If you are in any doubt regarding this, please check with your local authorities before placing any order.
All Products shipped overseas, by international Courier, are insured by BearTartan. The cost is included in the shipping charges. Products shipped within the UK, EU and overseas by Courier are trackable and insured. Delivery dates are guaranteed between 2-5 days, dependant on which country the kilt is being shipped to.
The BearTartan Kilt weighs 2.4 kg and the prices charged for shipping reflect the cost for sending an item of this value and weight, safely and securely to you the customer.
BearTartan will endeavour to take all reasonable steps to comply with delivery dates quoted. We use couriers with guaranteed delivery dates. However, we cannot be liable for failure, delay (such as customs clearance) or error during the shipping process that is out with our control.
Our delivery may offer online order tracking. If available, we will email you the tracking number at the time of dispatch.
If in the very unlikely event, of unforeseen circumstances, that we are unable to dispatch an order by the expected date and if we find that we cannot meet the maximum time indicated, we will contact you as soon as we know of this with a new expected schedule.
Always sign for deliveries as "UNOPENED". It is very rare that it happens, but if you suspect that the kilt in your package might be damaged, do not refuse it. Keep the package and sign for the loss/damage and notify us immediately. We will then forward you instructions about returning the item.
Kilts made to order for your own personal requirements or specifications (e.g. the kilt made to your own specific measurements) are not eligible for return, unless we have not supplied the kilt to the specifications given to us by you the customer or if the kilt is defective or not conforming to details explicitly advertised on our site.
If, in the unlikely event you have to return the kilt, please ensure that all temporary holding stitching (in kilt pleats) remain intact. Any wearing of the kilt, other than that of trying the kilt on for size, or removing of the aforementioned pleat holding stitches will invalidate your claim for return and consequently BearTartan will not be liable.
It shall be your responsibility to inspect and check the kilt as soon as reasonably practicable after delivery and in any event, not more than 48 hours after delivery to ensure that the quality, condition, quantity and specification of the kilt conform to the instructions contained in your order.
Any return claim based on significant defects in quality or specifications must be notified to us by email within 48 hours of receiving the kilt. We shall replace the kilt free of charge.
You will not be charged the costs of your return or re-shipping charges if the kilt is faulty or not meeting your orders specifications. For other returns you will be responsible for all return costs, including any re-importation duties or other taxes.
It is the customer's responsibility to reclaim any duties paid on the kilt which has been subsequently returned. All receipts and proof of return posting should be kept.
Please note that once an order has been placed, we can accept no responsibility for changes or cancellations. However, if you email us and your order has not yet been processed and commenced the kilt making process, we will do our best to make any changes you request at no extra cost.
Any dispute arising out of your order from BearTartan will be governed by the laws of Scotland.
Any real or apparent attempt at fraud against BearTartan will be reported to the police, credit card agencies, and any other relevant authorities. Each electronic entry carries the computer coding of the Internet provider through which the individual can be traced.
Bear Tartan reserves the right to refuse orders from more volatile countries, due to high levels of fraud and loss of packages.
The graphics, code and text contained in this web site are protected by copyright and any unauthorised use is an infringement of legal copyright.
